What it is:

Theft of cable or utility services is a crime in which the offender alters the infrastructure or operation of a utility or cable device with the intention of getting those services (for themselves or others) without paying.

Degree

Depending on the facts, theft of utility or cable services can be charged as a 2nd degree felony, 3rd degree felony, class A misdemeanor or class B misdemeanor.

Elements

A defendant commits a 2nd degree felony theft of utility or cable services when they commit any prohibited acts which make gas, electricity, water, sewer, or cable television available to a tenant or occupant, including himself, with intent to avoid due payment to the utility or cable television company and

  • the value of the gas, electricity, water, or sewer service is or exceeds $5,000 or
  • if the offender has previously been convicted of a violation of theft of utility or cable television services.

A defendant commits a 3rd degree felony theft of utility or cable services when they commit any prohibited acts which make gas, electricity, water, sewer, or cable television available to a tenant or occupant, including himself, with intent to avoid due payment to the utility or cable television company and the value of the gas, electricity, water, or sewer service is or exceeds $1,500 but is not more than $5,000.

A defendant commits a class A misdemeanor theft of utility or cable services when they commit any prohibited acts which make gas, electricity, water, sewer, or cable television available to a tenant or occupant, including himself, with intent to avoid due payment to the utility or cable television company and the value of the gas, electricity, water, or sewer service is or exceeds $500 but is not more than $1,500.

A defendant commits a class B misdemeanor theft of services when they commit any prohibited acts which make gas, electricity, water, sewer, or cable television available to a tenant or occupant, including himself, with intent to avoid due payment to the utility or cable television company and the value of the gas, electricity, water, or sewer service is less than $500.

Fine

2nd degree felony: A fine not to exceed $10,000, plus a 90% surcharge.

3rd degree felony: A fine not to exceed $5,000, plus a 90% surcharge.

Class A misdemeanor: A fine not to exceed $2,500, plus a 90% surcharge.

Class B misdemeanor: A fine not to exceed $1,000, plus a 90% surcharge.

Restitution

The court may order the accused to pay restitution if convicted of this crime.

Imprisonment

2nd degree felony: A term of imprisonment not less than 1 year nor more than 15 years.

3rd degree felony: A term of imprisonment not to exceed 5 years.

Class A misdemeanor: A term in jail not to exceed 1 year.

DNA Specimen Analysis

A defendant convicted of a class A misdemeanor, 2nd or 3rd degree felony theft of cable or utility services must provide a DNA specimen.

Firearms

A defendant convicted of a 2nd or 3rd degree felony theft of cable or utility services may not posses, use or have control of a firearm or ammunition for life.
