Assault Against a School Employee

Utah Code §76-5-102.3

Degree

Class A misdemeanor.

Elements

A defendant commits a class A misdemeanor assault against a school employee when they engage in one of the following:

  • (a) attempt, with unlawful force or violence, to do bodily injury to another;
  • (b) threaten, accompanied by a show of immediate force or violence, to do bodily injury to another; or
  • (c) an act, committed with unlawful force or violence, that causes bodily injury to another or creates a substantial risk of bodily injury to another person and the victim is an employee of a public or private school, with knowledge that the individual is an employee, and when the employee is acting within the scope of there authority as an employee.
Fine

Class A misdemeanor: A fine not to exceed $2,500, plus a 90% surcharge.

Restitution

The court may order the accused to pay restitution if convicted of this crime.
(Utah Code Ann. §77-38a-301)

Imprisonment

Class A misdemeanor: A term in jail not exceed 1 year.
(Utah Code Ann. §76-3-204(1))

DNA Specimen Analysis

A defendant convicted of a class A misdemeanor assault against a school employee must provide a DNA specimen.
