Class A misdemeanor.

Elements

A defendant commits assault against health care provider and emergency medical service worker when they assault a health care provider or emergency medical service worker if:

  • the defendant knew that the victim was a health care provider or emergency medical service worker;
  • and the health care provider or emergency medical service worker was performing emergency or life saving duties within the scope of their authority at the time of the assault.
Fine

Class A misdemeanor: A fine not to exceed $2,500, plus a 90% surcharge.

Restitution

The court may order the accused to pay restitution if convicted of this crime.
(Utah Code Ann. §77-38a-301)

Imprisonment

Class A misdemeanor: A term in jail not to exceed 1 year.

DNA Specimen Analysis

A defendant convicted of a class A misdemeanor assault of a healthcare worker must provide a DNA specimen.
